High-Stakes Zoning Litigation Case Scores Big Win

Sixth Circuit upholds decision of trial court granting Isaac Wiles’ Motion to Dismiss a developer’s claim

Isaac Wiles scored a win for a Board of Commissioners in Southwest Ohio in a constitutional zoning case at the United States Sixth Circuit Court of Appeals. In the unanimous three judge panel opinion, the Sixth Circuit upheld the decision of the trial court granting Isaac Wiles’ Motion to Dismiss a developer’s claims. Specifically, the Sixth Circuit upheld the District Court’s decision which agreed with Isaac Wiles’ arguments that the developer failed to state a cognizable property interest under the Due Process Clause or plead a violation of the Equal Protection Clause.
